Terms & Conditions

SAFARI SEEKERS is hereafter referred to as “SS” with a registered office in Nairobi, Kenya. (East Africa)

All services are supplied by SS and other suppliers who are independent entities and defined as suppliers. SS cannot accept any liability for services or arrangements for any loss or damage incurred as a result of the acts and or defaults of any suppliers or third party.

Prices:

Prices are quoted in US dollars. All prices are subject to change without prior notice. Should prices or costs from suppliers increase due to inflation, currency depreciation, and fuel surcharges, SS will reserve the right to amend the quotation cost accordingly. All suppliers reserve the right to increase prices at any time of the year when costs increase outside of their control. Please note that if clients’ itineraries overlap two seasons, the price will be prorated over the two seasons. Child rate is only applicable to one or two children under 12 years sharing a room with 2 adults. In case two children share a room with parents, the two children will share a bed as most hotels/lodges cannot accommodate a fourth bed. One child sharing a room with one adult will be charged full adult rate. Two children sharing their own room will be charged 75% of adult room rate.

Single Travellers:

Our safari costs are based on double occupancy. However, we try to accommodate single travelers who request single accommodations, as well as those who are looking for a roommate. If a single room is requested, or we are unable to find a suitable roommate, you will need to pay the single supplement. Single accommodations are not available on all safaris. Each group allows a limited number of single room allotments.

Gorilla Permits:

Gorilla Permits are only available in a limited number per day. When available, the purchase needs to be made immediately to secure your spot. Please note that they are 100% non-refundable upon purchase.

Cancellation Policies:

If you wish to cancel your holiday, you must notify SS in writing as soon as possible. Your notice of cancellation is only effective when it is received in writing. In such cases the following cancellation charges will apply;

  • Low Season: Less than 60 days 25%; Less than 45 days is 50%; Less than 15 days is 100%; Beyond 60 days – Full refund except bank charges (including service fees) and non-refundable deposits (if any) at the hotels and air tickets
  • Peak Season: Less than 90 days 25%; Less than 45 days is 50%; Less than 30 days is 100%; Beyond 90 days – Full refund except bank charges (including service fees) and non-refundable deposits (if any) at the hotels and air tickets

Some safaris may incur additional cancellation fees (especially Gorilla safaris). There will be no refund for any unused portions of a safari once it has commenced. Cancellation penalties on airfares and Gorilla permits are additional and may not be included in the above cancellation charges.

Note: Insurance for the total land tour cost is strongly recommended from your country of origin.

Although it rarely happens, SS reserves the right to cancel tours and other arrangements. If your holiday is cancelled (other than your default in payment) due to unavoidable circumstances beyond our control e.g. over bookings, SS will offer you the choice of purchasing an alternative holiday (and paying or receiving a refund in respect of any price difference) or receiving a full refund of all monies paid to them. If a safari is canceled by SS because of extraordinary conditions, all monies paid to Africa Keys will be held in credit which can be utilized at a later date. SS does not accept responsibility for any other expenses incurred for preparing for the safari outside of what is included within their costs.

Age Restriction:

In certain Camps, Lodges, Hotels, Beach Resorts, and on specific activities, minimum age limits apply. For example, the age limit for Gorilla Safaris is 15 years. These will be communicated to you through your quotation.

Flights:

In the unlikely event of flight delays the airlines concerned are not to be held liable for any act, omission, or event during the time the passengers are not on board their aircraft or conveyance.

Flight delays are not considered as alterations to the program and as a consequence, any compensation applied for from SS is not applicable. In the event of a scheduled flight delay, cancellation, or overbooking, SS will not be held liable for any costs incurred. Any denied boarding compensation if applicable should be sought directly from the airline concerned and not SS.

SS cannot guarantee that flight times detailed on the itinerary will not change at short notice. If in any event they do, SS will make every available effort to assist in obtaining a suitable alternative flight. Any additional cost of accommodation or change in itinerary caused by a flight schedule change, will be borne by the client, and will be payable immediately, in order to confirm reservations.

Travel Protection Plan:

Cancelling your safari can be very costly as we have to adhere to the cancellation fee schedule above. We highly recommend that you purchase a Travel Protection Plan, which will protect you from penalties if you cancel for a covered reason. In addition, there is coverage for trip interruption, trip delay, and protection for emergency evacuation, accident, and sickness medical expense. SS is not responsible or liable for loss, damage, or theft of personal luggage and belongings, or personal injury, accident, or illness.

Travel Itinerary Inclusions:

Services of pre-departure information to help you get the most out of your safari.

  • All scheduled transportation during the safari unless otherwise specified
  • All transfers, meet and greet by SS staff
  • All meals as indicated in your itinerary
  • All taxes and service charges
  • Transportation in custom-made safari vehicles
  • All Park Fees
  • Expert, certified Guides
  • All activities as specified in your itinerary

Exclusions:

  • Temporary flying doctors membership $20 (recommended) AMREF emergency Air Evacuation is limited to safaris in East Africa
  • Fees for passports and visas
  • Airport departure taxes
  • Tips to drivers and guides
  • Personal expenses such as laundry, beverages, phone calls, etc…
  • Tips to models for photographic opportunities

Force Majeure:

The expression ‘force majeure’ means any event(s) in which the supplier(s) in question could not have foreseen or avoided even with all due care. Such events may include war or threat of war, riots, civil strife, industrial dispute, terrorist activity, pandemics, natural or nuclear disaster, fire, adverse weather conditions, government action, and all similar circumstances outside the suppliers’ control. In these circumstances, the suppliers shall not be liable to pay any compensation or otherwise be responsible for any expenses or losses you incur, whereby the supplier is forced as a result to cancel, delay, curtail, or change your holiday arrangements in any way or where the performance or prompt performance of the suppliers’ contractual obligations are prevented or affected.

Complaints:

If in the unlikely event a tour member has a dispute while on safari, this must immediately be brought to the attention (and put on record) of the local representative, Hotel, Lodge, or Camp management. It is likely that the tour member’s complaint will be satisfactorily resolved there and then. If, however, this is not the case and the tour member wishes to pursue the matter upon their return from safari, it is required to be communicated in writing to SS within 14 days of the end of tour, quoting your tour reference, destination, departure date and the nature of dissatisfaction. SS cannot accept responsibility of any complaints that are not notified entirely in accordance with this clause.

SS acts only as the Agent for the suppliers and shall not in any event be held liable for any negligence, breach of contract, or acts of omission on the part of suppliers, their employees, or any other Agent. It shall be the responsibility of all customers including (without limitations) Tour members, Tour Operators and Travel Agents, to read and familiarize themselves with the Terms and Conditions of suppliers. SS’s liability for its own negligence or breach of contract shall be limited to the Tour price.

Release pf Liability:

In consideration of the services and arrangements provided by SS for yourself and for your heirs, personal representatives, or assigns, do hereby release, waive, discharge, hold harmless, and agree to indemnify SS, and its owners, officers, directors, agents, contractors, subcontractors, and employees from any and all claims, actions, or losses for bodily injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages, or otherwise that may arise out of, or occur during your travel in connection with the scheduled travel package, and any activities conducted in conjunction therewith.
